This agreement creates a conservation easement in real estate legally described as: A tract of land located in the Southeast Quarter of the Southwest Quarter of Section 1, Township 52, Range 30, described as follows: Beginning at a point on the East line of Main Street in the City of Excelsior Springs which is 230 feet South of the intersection of the East line of Main Street and the South line of Broadway; thence from said point of beginning South along the East line of Main Street a distance of 165 feet; thence East and parallel with the South line of Broadway a distance of 65.4 feet to a point on the Westerly line of a concrete strip; thence North along the west line of said concrete strip a distance of 45 feet to a point that is 65.7 feet East of the East line of Main Street; thence West .7 of a foot to a point that is 65 feet East of the East line of Main Street; thence North and parallel with the East line of Main Street a distance of 120 feet; thence West parallel with the South line of Broadway a distance of 65 feet to the point of beginning; the property herein described as being designated as City Blocks 68, 69, 70 and part of 71 on the Official City Map of Excelsior Springs. ALSO a tract of land described as follows: All that part of the Southeast Quarter of the Southwest Quarter of Section 1, Township 52, Range 30 described as follows: Beginning at a point that is 65 feet East of a point that is 230 feet South along the East line of Main Street from the Southeast corner of Main and Broadway Streets in the City of Excelsior Springs; thence South 120 feet; thence East 10 feet; thence North 120 feet; thence West 10 feet to the point of beginning. The Subject Property, the Hall of Waters, is located at 000 Xxxx Xxxxxxxx, Excelsior Springs, Clay County, Missouri (hereinafter referred to as the “Property”), which is owned in fee­simple by the Grantor and is listed in the National Register of Historic Places as the “Hall of Waters, Siloam Park and Springs.”
The Subject Property. Effective upon the execution and -------------------- delivery of this Lease Supplement by the Lessor and the Lessee, the Subject Property shall be subject to the terms and provisions of the Lease, and the Lessor hereby leases the Subject Property to the Lessee, and the Lessee hereby hires and leases the Subject Property from the Lessor. The term of the Lease with respect to the Subject Property begins on the date hereof and ends on November 30, 2005, subject to the right of the Lessee to extend the Lease in accordance with the terms and conditions set forth in the Lease and the other Operative Documents. The Lease contains certain purchase rights and options during the term of the Lease pursuant to which the Lessee may acquire the Subject Property, all as more fully set forth in the Lease.
The Subject Property. The Subject Property, previously a small portion of the Van Lierop Bulb Farm, was acquired by Step by Step from the City. It consists of approximately six acres spanning two parcels: Pierce County parcel numbers 0420253070 and 0420253071, which are legally described in Exhibit A (East Property).
The Subject Property. The subject property is generally described as follows: • located on the north side of Xxxxx Lake Road in close proximity to the Beaver Bank Road within the community of Beaver Bank (Maps 1 and 2); • designated Mixed Use A under the Generalized Future Land Use Map (Map 1) of the Beaver Bank, Xxxxxxxx Plains and Upper Sackville Municipal Planning Strategy (MPS) and designated Rural Commuter under the Regional Plan; • zoned MU-1 (Mixed Use 1) under the Beaver Bank, Xxxxxxxx Plains and Upper Sackville Land Use By-law (LUB) (Map 2); • 1.66 hectares (4.11 acres) in area; • 114.5 m (375.5 ft.) of road frontage on Xxxxx Lake Road; • contains a main building which is approximately 93 m2 (1,000 sq.ft.) and two accessory buildings. both approximately 18 m2 (192 sq.ft.) in floor area; • surrounded by existing low density residential development (single and two unit dwellings); • contains mature trees which screen the property from the surrounding residential uses; and • was previously used as a commercial bus depot.
The Subject Property. School District holds title to certain land currently located in the incorporated area of the City of Jefferson legally described in the attached Exhibit A (the “Subject Property”).
