Forms to be used The changes to the Act are based upon a concept that requires the application of "individual agreements", between the employer and an employee. The Act states that these "agreements" must be in writing and that they must contain the signatures of both parties to the "agreement". In addition, the Act now contains a specific requirement that any payment in lieu of long service leave made to an employee must be recorded on a form as prescribed by the Act, known as Schedule 2A. A copy of this form is attached and is basically self explanatory. We need to use the form headed "Application for Payment in Lieu of Long Service Leave" as the "individual agreement". This form can be given to employees when they make an inquiry or request for a payment in lieu of long service leave. This form must be fully completed and retained on the employee's file as proof of the individual agreement, as well as providing a copy to the employee. The Act then specifies that we must also give a copy of Schedule 2A to the employee when we actually make a payment in lieu of long service leave. The Act specifies that this form must be exactly as it appears on the attached form and not be altered in any way.   • SAVINGS/FORCE MAJEURE A Force Majeure occurrence is an event or effect that cannot be reasonably anticipated or controlled and is not due to the negligence or willful misconduct of the affected party. Force Majeure includes, but is not limited to, acts of God, acts of war, acts of public enemies, terrorism, strikes, fires, explosions, actions of the elements, floods, or other similar causes beyond the control of the Contractor or the Commissioner in the performance of the Contract where non- performance, by exercise of reasonable diligence, cannot be prevented.   • De-commissioning due to Emergency 17.6.1 If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants de-commissioning and closure of the whole or any part of the Bus Terminal, the Concessionaire shall be entitled to de- commission and close the whole or any part of the Bus Terminal to Users and passengers for so long as such Emergency and the consequences thereof warrant; provided that such de-commissioning and particulars thereof shall be notified by the Concessionaire to the Authority without any delay, and the Concessionaire shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency.

  • Developer Compensation for Emergency Services If, during an Emergency State, the Developer provides services at the request or direction of the NYISO or Connecting Transmission Owner, the Developer will be compensated for such services in accordance with the NYISO Services Tariff.

  • LAY-OFFS AND RECALLS In the event of a lay-off, employees within the affected level shall be laid-off in reverse order of their bargaining unit seniority.
