Supply Capacity. Water Boards are infrastructure intensive organisations and central to this is the need to plan, provide, operate, maintain, replace and refurbish the bulk water supply infrastructure in a manner that ensures availability and integrity of the infrastructure is not compromised. This will minimise disruptions or failure to provide water. Bulk water supply delivery/infrastructure arrangements are typically made up of the primary system components illustrated in the following process diagram: The table below outlines the source, pumping systems, storage and areas serviced per region:
Supply Capacity. Subject to Section 3.1(a), Novo Nordisk Delivery Technologies, Inc. shall maintain sufficient production capacity for the current and forecasted requirements of Packaged Device and/or Packaged Dosage Form, as set forth in the applicable Forecast as defined below.

SUPPLIER commits to at all times to have sufficient capacity to manufacture and deliver Products according to VESTAS’ non-binding long-term forecast according to Appendix C (“Supply Capacity”) and that VESTAS’ orders and the fulfilment hereof at all times shall have first priority. SUPPLIER is obligated to confirm orders and deliver in accordance with orders received from VESTAS, which are in accordance with the Supply Capacity within (3) three days. In case SUPPLIER is not able to confirm orders within the agreed Supply Capacity, SUPPLIER shall pay liquidated damages as set forth in Clause 3.7. as if a formal Contract had been established.

Furthermore, with regard to the non-binding forecast set forth in Section 2.2.3 hereof and the long-term forecast set forth in Section 2.7 hereof, Adolor shall promptly notify GSK if Adolor believes that it shall be unable to meet such forecasted amounts.
