Supplementary Agreement. In any voluntary or involuntary bankruptcy proceeding involving Seller, failure by Company to assert its rights to "retain its rights" to the intellectual property encompassed by the Source Code or the funds in the Proceeds Escrow, pursuant to Section 365(n)(1)(B) of the Code, under an executory contract rejected in a bankruptcy proceeding, shall not be construed as an election to terminate the contract by Company under Section 365(n)(1)(A) of the Code.

Supplementary Agreement. 1 Traffic Improvements to Tuen Mun Road Town Centre Section (the Project) under Agreement No. HMW 5/2009 (EP) Traffic Improvements to Tuen Mun Road Town Centre Section. The Project was commenced on August 2010 and to be completed on January 2014. Location of the works area is indicated in Figure 1.1. The Project involves widening the following sections of TMR from dual-two carriageway to dual-three carriageway: - Xxxx Xxx Road Section, (from Xxxx Xxx Road Interchange to Xxxx Xxxx Road); - Tuen Mun Town Plaza Section, (from Yan Oi Town Square to Xxxx Xxxx Road). The Project is a designated project under Schedule 2 of the Environmental Impact Assessment (EIA) Ordinance (Cap. 499). Environmental Monitoring and Audit (EM&A) work is required in accordance with the conditions stipulated in the Environmental Permit (EP) (EP-342/2009/C) and the EM&A Manual of the Project. The rolling construction programme during the reporting period is attached in Appendix A. The major construction activities carried out by the Contractor in the reporting period are summarized in Table 1.1.
Supplementary Agreement. For purposes of the Fourth Amended and Restated Limited Liability Company Agreement of PrinceRidge Partners LLC (the “LLC Agreement”) and the Fourth Amended and Restated Limited Partnership Agreement of the Company (the “LP Agreement”), this Agreement shall be treated as a Supplementary Agreement (as defined thereunder).
Supplementary Agreement. During the period of the lease, if this contract shall be terminated ahead of schedule because of the factors such as national policy changes or a force majeure, Party A shall notify Party B half a month early. Party B shall transact the formalities of termination of the contract according to the requirements of the notification and leave the house on time. Party A is not responsible for the losses cause by the above factors, but shall return the rent that Party A has paid but has not use yet.
Supplementary Agreement. In case of matters not mentioned herein, both parties may sign a supplementary agreement separately to clarify such matters. The supplementary agreement shall have the same legal effect as this Contract. In case of any conflict between the contents of the supplementary agreement and this Contract, the contents of the supplementary agreement after the signing date shall prevail.
