Subcontractor Performance. The Contractor certifies full responsibility for Contract performance, including subcontractors, and that comparable Contract terms will be included in subcontracts, and that the Department will not be required to directly or indirectly manage subcontractors or have any payment obligations to subcontractors. . EXECUTIVE ORDERS For covered Executive state Departments, the Contractor certifies compliance with applicable Executive Orders (see also Massachusetts Executive Orders), including but not limited to the specific orders listed below. A breach during period of a Contract may be considered a material breach and subject Contractor to appropriate monetary or Contract sanctions.

Subcontractor Performance. Subcontractor performance where permitted by Buyer (see Schedule "C" paragraph 4) shall be under the control and responsibility of Seller and Seller shall be liable for the acts or omission of its subcontractors in failing to comply with its obligations to Buyer hereunder. Seller recognizes its responsibility for delivery of items supplied by third parties as well as direct deliveries by Seller. Seller agrees to follow up as promptly as practicable on quality problems and past-due orders, and to keep appropriate Buyer locations advised as to the status of such on a timely basis. Seller agrees to establish a system to track and evaluate such performance of third parties, and to consider such performance in selecting third party suppliers.
Subcontractor Performance. In consideration of Subcontractor’s performance of this Subcontract, and at the times and subject to the terms and conditions set forth herein and in Exhibit A, Contractor shall pay to Subcontractor the agreed upon sum based on the subcontract documents governing price per project or service request., hereinafter “Subcontract Sum”. Said subcontract price is dependent upon the conditions set forth in Exhibit A being met. Should said Special Conditions not be met, the Subcontract Sum shall be modified accordingly.
Subcontractor Performance. 6.1 The Subcontractor shall not assign the Work of this Subcontract without the written consent of the Contractor, nor subcontract the whole of this Subcontract without the written consent of the Contractor’s Project Manager. As a precondition to agreement to subcontract any labor or materials, Subcontractor agrees to obligate any Sub-subcontractor to be mutually bound by all of the terms and conditions of this Subcontract Agreement.
Subcontractor Performance. A subcontractor is a person, firm, company or corporation who has a contract with the Bidder to perform any work for completing the project. The awarded Bidder shall be responsible for the actions, inactions, and work performed by the subcontractor. Contracts between the Bidder and the subcontractor shall be in accordance with the terms of the awarded contract by the Municipality to complete the SOW, Section 4. The selected Bidder shall furnish to the Municipality, in writing, a list of any/all subcontractors proposed to perform any part or portion of the SOW to complete the project. The selected Bidder shall not employ any subcontractor to whom the City objects, and may withdraw their Bid or submit an acceptable substitute.
Subcontractor Performance. Any subcontract entered into by Contractor relating to this Agreement, to the extent allowed hereunder, shall include a like provision for work to be performed under this Agreement to contractually bind or otherwise oblige its subcontractors performing work under this Agreement such that the City’s ownership and license rights of all Work Products are preserved and protected as intended herein. Failure of Contractor to comply with this requirement or to obtain the compliance of its subcontractors with such obligations shall subject Contractor to the imposition of any and all sanctions allowed by law, including but not limited to termination of this Agreement.

  • Data Necessary to Perform Services The Trust or its agent shall furnish to USBFS the data necessary to perform the services described herein at such times and in such form as mutually agreed upon.

  • Time for Performance 1.1. The term of this SOW Agreement shall begin on and end on (the “Initial Term”). The Initial Term may be extended as the parties may agree. If the Master Agreement should expire or otherwise terminate prior to the end of the term of this SOW Agreement, this SOW Agreement shall continue to the end of its existing term, unless or until terminated in accordance with the terms of this SOW Agreement, and the Parties acknowledge and agree that the terms of the Master Agreement shall survive and apply to this SOW Agreement.
