Spousal Beneficiaries. If the sole primary Beneficiary is the deceased Owner’s “spouse” (as defined by federal law), upon Notice to Us from your surviving spouse, in lieu of receiving the Death Benefit, the Contract may be continued with the surviving spouse as the new Owner, pursuant to Section 72(s) of the Code and the following will apply:

Spousal Beneficiaries. If, at the Certificate Owner's death, the surviving spouse of the deceased Certificate Owner is the sole Beneficiary and the surviving spouse elects to continue the Certificate as his or her own pursuant to Section 72(s) of the Code or the equivalent provisions of U.S. Treasury Department rules for qualified plans the following will apply:
