Software Distribution. If You provide or distribute any software at the Event, the use terms and/or the end user license agreement provided or distributed with such software will govern the use of the software, and in the event of any conflict with the terms of this Agreement, such use terms and/or other license agreement will control.

Software Distribution. 5.1. Distribution of the Software is not allowed. Distribution is defined, inter alia, as: providing third party access to any kind of copies of the Software or its components, including selling, lending, leasing, loaning or gifting.

Pricing has been provided for media and documentation under individual CLINs, however, some products may be open market items and not available on GSA Schedule. All such products are clearly identified “open market item”. Orders under this BPA may include media and documentation when purchased in accordance with the following standard GSA terms. For single product orders where media is purchased, shipment will take place directly from Microsoft within 48-72 hours of order submission from Dell to Microsoft. Microsoft uses a combination of shipment methods including postal delivery and customers should expect to receive the media approximately 7 days from ship date. For new Microsoft Enterprise Agreements (license with Software Assurance) that exceed 250 desktops, customers will receive, at no charge, a single media comprehensive kit and subscription that will provide updates for the agreement term. Delivery times are similar to single products.
