Software Distribution a. You are entitled to distribute Software to Customers and HPE Authorized Partners, as authorized by this Addendum, for resale or internal use, respectively.
Software Distribution. If You provide or distribute any software at the Event, the use terms and/or the end user license agreement provided or distributed with such software will govern the use of the software, and in the event of any conflict with the terms of this Agreement, such use terms and/or other license agreement will control.

Before delivering any computer program to Publisher, Software Owner must first test the computer program to ensure it is, to a reasonable extent, free of defects. Bug Fixes. Software Distribution a. No part of the software may be re-sold or commercially distributed, either separately or as part of a commercial product. If you desire to distribute the software as part of a commercial product, you must contact ProModel Corporation and sign a royalty/license agreement permitting such distribution;
Software Distribution. Each license includes software distribution via magnetic tape or diskettes at no additional charge. Disk distributions for certain disk drives are available at extra charge.

Pricing has been provided for media and documentation under individual CLINs, however, some products may be open market items and not available on GSA Schedule. All such products are clearly identified “open market item”. Orders under this BPA may include media and documentation when purchased in accordance with the following standard GSA terms. For administrative convenience, open market (non-contract) items may be added to a FSS BPA or an individual order, provided that the items are clearly labeled as such on the order, all applicable regulations have been followed by the ordering activity, and price reasonableness has been determined by the ordering activity for the open market (non-contract) items. For single product orders where media is purchased, shipment will take place directly from Microsoft within 48-72 hours of order submission from Dell to Microsoft. Microsoft uses a combination of shipment methods including postal delivery and customers should expect to receive the media approximately 7 days from ship date. For new Microsoft Enterprise Agreements (license with Software Assurance) that exceed 250 desktops, customers will receive, at no charge, a single media comprehensive kit and subscription that will provide updates for the agreement term. Delivery times are similar to single products.
