Security of Tenure. (IF APPLICABLE) The Purchaser acknowledges that it is acquainted with the provisions of the Extension of Security of Tenure Act No.62 of 1997 and the factual position regarding the occupants of the property. The Purchaser also acknowledges that it is aware that the provisions of the said Act are binding on the Purchaser as successor in title of the Seller and the Immovable Property is sold subject to the said provisions and any alleged occupancy rights.

Security of Tenure. 2.1 The Contractor shall have security of tenure and this contract shall not be suspended, terminated or revised except in accordance with sections 20, 21 and 24 hereof.

Security of Tenure. 2.2.1 As long as you occupy the property as your only or principle home, we can only end the tenancy by obtaining a Court Order for Possession. If you fail to occupy the premises as your only or principal home we can end the tenancy in the manner set out below.
Security of Tenure. The standard draft lease indicates (at clause 43) that the lease will not be a protected business lease under the Landlord and Xxxxxx Xxx 0000, unless it is for a term of 15 years or more. This is a clause which is usually negotiated but the consequences of this fact need to be appreciated by all practices. If a lease IS protected by the Landlord & Xxxxxx Xxx 0000 it means, in very basic terms, that the tenant has a statutory right to call for a new lease on substantially the same terms as the old one (save for rent) at the end of the lease term. The Landlord would only be able to refuse the granting of such a lease in limited circumstances (such as where the landlord is looking to redevelop the premises). If the lease IS NOT a protected lease then the tenant has no statutory right to remain and it would be at the discretion of the landlord as to whether or not a new one is granted. Security of Tenure. You have security of tenure as an assured tenant so long as you occupy your home as your only or principal home. If you stop living in your home as your only or principal home, you will lose security of tenure and this tenancy will no longer be an assured tenancy. If this happens, we can give four weeksnotice in writing to end the tenancy. If, at the expiry of the notice, your home is occupied, we will still need a possession order from the County Court.
