Scheduled Delivery. 5.1.1 Seller anticipates that, the Facility will achieve the Commencement Date by the Scheduled Commencement Date and shall be fully capable of reliably producing the power and Energy to be provided under this Agreement to Purchaser at the Delivery Point; provided, however, that if and to the extent that a Force Majeure event affects Seller's ability to timely comply with the foregoing guarantee, the Scheduled Commencement Date shall be extended by the amount of time Seller reasonably needs to remedy the effects of the Xxxxe Majeure that prevented Seller's performance (and in this regard, the Parties shall follow the procedures contemplated in Section 11).

Priority Service & Scheduling Silver Service Plan customers will receive daytime priority service from our highly skilled and licensed technicians.
Scheduled Delivery. When an order is placed for goods to be supplied to the Customer against schedules of his requirements, sent to the Company from time to time, the minimum number or quantity of goods stated in the order must be shipped within twelve calendar months or such other period as the Company has specified in writing to the Customer.
Scheduled Delivery. SmarTire shall specify a required delivery date on the purchase order. Within 3 working days from receipt of the purchase order, HACO shall provide an acknowledgement of the purchase order confirming the required shipment date, or specifying the date on which they are able to provide shipment of the Products. HACO shall use good faith and best efforts to ship the Products within a 4 week period from receipt of the component parts for each purchase order.

Upon confirming a Order Form, Seeing Machines will use commercially reasonable efforts to make the Products available for delivery to the Client, and/or to provide the Services, by the date/s agreed in writing, however these dates are targets only and Seeing Machines will not be liable for late delivery.
