Relationship between Article XVIII:B and C. In the Report of the Working Party on the “Accession of Tunisia” the representative of Tunisia pointed out that “as a provisional member, Tunisia had observed the provisions of Article XVIII:B of the General Agreement together with the appropriate procedures governing its application and would continue to do so in the future. He recalled, nevertheless, that Article XVIII:C of the General Agreement and the 1979 CONTRACTING PARTIES’ Decision on Safeguard Action for Development Purposes recognized to developing countries the right to protect infant domestic industries …A member recommended that Tunisia not invoke Article XVIII:B to justify protective measures taken for development purposes to establish or protect infant industries. Rather, Tunisia should adhere to the provisions of Article XVIII:C or XVIII:D, or other GATT provisions as appropriate, to justify protection for these reasons ...”.87
