(1) Subject to subclause (2) if the State constructs a railway to Beenup suitable for the transport to Bunbury of heavy minerals, heavy mineral concentrates and heavy mineral products the Company shall have the right to use the railway on such reasonable terms and conditions as are agreed with the Commissioner of Railways PROVIDED THAT as part of such terms the Company shall not be required to contribute to the capital costs to construct the railway.

Rail transport. The transition to a more sustainable transport is obstructed by the unreliability and poor consumer experience of Romania’s rail transport. In 2012, the national railways network included 15,871 km interoperable and 4,206 km non‐interoperable, being in regress in comparison to previous year and had a national average of 45.2 per 1000 km2. 23.6% of the total railways length is on core TEN‐T network and 44.14% are on comprehensive TEN‐T network. The railway network is in a continuous degradation process since 1990, that, in addition to old rolling stock (approx. 70%), leads to increased journey time. 5,919 km of railway need urgently to be rehabilitated/modernized because their life duration is expired. Traffic speed is of approx. 59 km/h for passengers’ trains and of approx. 39 km/h for freight trains. At the end of 2012, the total length of network operable railways was of 10,777 km, of which 4,020 were electrified. The low level of maintenance of railway infrastructure, due to insufficient financing, leads to the regress of technical parameters, with direct effects on speed decreasing and travel time increasing. Speed decreasing is an effect of improper/old status of rail infrastructure, being reflected in diminishing clients’ interest for this transport mode. During 2007 – 2012 the traffic have been diminished with 11%, from 95.7 mil. train‐km in 2007 to 85.2 mil. train‐km in 2012. Starting 2011 the rail network was rationalised: following the implementation of the Stand‐by Agreement with the IMF and the EC around 1,000 km were closed. In this way the target was reached: CFR puts 15,500 km directly to the rail operators. In next years, it is planed also to rent another 1,500 km of non‐interoperable railway, through tendering. In order to streamline the rail, the number of railway stations in the country decreased (were closed) from 1.301 in 2001 to 932 in present, but most of them are not rehabilitated and offer low quality services, traffic volume being an important element in their prioritization. The decreasing of traffic on rail transport sector is mainly linked by the low quality of services and not by the lack of people’ interest in traveling by trains. Significant investment will be required, in accordance with the GTMP, to enable rail to compete effectively with road within the inter‐regional passenger and freight transport market. Rail transport. The parties agree to continue efforts to improve rail transport, particularly in densely populated areas and where the volume of goods traffic is high. Because railway investments have lagged behind in the national transport plans, investments in the railways are to be increased proportionately more than investments in roads in 2009. The parties agree that to achieve this, the allocation for railway investments will be increased by NOK 250 million in the 2009 Fiscal Budget.

That capacity may be limited to the operation of specific types of transport services; – licensing authority shall mean the body charged by each Contracting Party with the issue of licences; – train path shall mean the infrastructure capacity needed to run a train between two places at a given time; – allocation shall mean the allocation of railway infrastructure capacity by an allocation body; – allocation body shall mean the authority and/or infrastructure manager designated by one of the Contracting Parties for the allocation of infrastructure capacity. – urban and suburban services shall mean transport services operated to meet the transport needs of an urban centre or conurbation, as well as the transport needs between such centre or conurbation and surrounding areas; – regional services shall mean transport services operated to meet the transport needs of a region; – combined transport shall mean the carriage of goods by heavy goods vehicles or loading units which complete part of their journey by rail and either begin or end the journey by road; – competitive rail transport prices: rail transport prices shall be considered competitive if the average rail transport prices in Switzerland are no higher than the road transport costs, as defined in Annex 9, for a similar route.

Rail transport. The LTT HC and LTT HC with AMMPS Kit shall be tested or otherwise evaluated for compliance to rail impact test requirements of MIL-STD-810, method 516.4, procedure VIII. Trailers shall be tested while coupled to the HMMWV and individually. Following impact testing trailers shall be evaluated for damage and tested for operability. Within the scope and conditions of this Treaty and within the scope and the conditions set out in the relevant acts specified in Annex I, railway undertakings licensed in an EU Member State, or by a South East European Party shall have the right of access to the infrastructure in all EU Member States and South East European Parties for the purpose of operating international rail passenger or freight services.
