Provisions of Services. The Foundation shall provide full reimbursement to MSJCCD, annually, for services performed by MSJCCD employees on behalf of the Foundation, set forth in Appendix A. No less than 50% of said reimbursement shall be provided to the MSJCCD as either direct general fund offset or Foundation scholarships/grants, in the form of donations and/or cash. The balance of services costs may be reimbursed in the form of in-kind contributions or non-monetary benefits provided by the Foundation to the MSJCCD, as authorized by California Attorney General Opinion 81 Ops. Atty. Gen. 111 (1998). The MSJCCD may require the Foundation to reimburse the MSJCCD for other expenditures incurred by the MSJCCD as a result of the Foundation’s activities. Such services shall be mutually agreed upon by the MSJCCD and Foundation in writing. The MSJCCD shall invoice the Foundation for such expenditures, with the invoice including an explanation of each item and the method of determining the cost of each item. The Foundation shall pay the MSJCCD for such invoice within thirty (30) days of the date of such invoice by making monetary reimbursements or by providing a statement of the in-kind contribution or benefits provided to the MSJCCD, as authorized by California Attorney General Opinion 81 Ops. Atty. Gen. 111 (1998).
