Provision of Utilities. 7.7.1 The Operator shall be solely responsible for arranging for all utilities for the operation and maintenance of the Facility. Notwithstanding the foregoing, the Authority shall be solely responsible to pay any outstanding dues or claims in respect of any utilities consumed at the Facility prior to the commencement of the Concession Period.

Provision of Utilities. It is the Owners responsibility to obtain written confirmation from the appropriate entities that all public utility requirements for the Land, including but not limited to telephone, underground without any expense, cost or obligation on the part of the Municipality and that all requisite easements have been or will be provided to such entities. It is the Owner’s responsibility to ensure that telecommunications, cable television, hydro-electric power, gas and postal services, have been satisfactorily arranged, that servicing for same will be provided underground without any expense, cost or obligation on the part of the Municipality and that all requisite easements have been or will be provided to such entities.
Provision of Utilities. Lessor will contract with all applicable Utility providers for the delivery and purchase of sufficient Utilities (and with respect to water, within acceptable industry standards) to the Xxxx Center Plant in sufficient quantities in order that BREP may perform its obligations under the Phase I Ancillary Agreements. The costs of all such Utilities shall be borne by Lessor, subject to the Off-taker Purchased Utility Reimbursement as described in Exhibit “K” to the CEA; provided, however, that if Lessor elects to terminate the Phase I Ancillary Agreements due to a Non-Appropriation Event and fails to pay the full Termination Fee due as a result thereof, and if BREP elects to keep this Lease in full force and effect pursuant to Section 3.3.f, then BREP shall be responsible for the costs of all such Utilities and shall reimburse Lessor therefor within thirty (30) days of BREP’s receipt of any invoices relating thereto.

Provision of Utilities. Lessor will provide, or cause to be provided to the Premises water, electricity, telephone, sanitary sewer, heat, ventilation and air conditioning. Lessee shall arrange for the furnishing to the Premises of such utility services as it may require, as well as for the installation of all meters or other devices. Lessee shall be solely responsible for and shall promptly pay, as and when the same become due and payable, all charges for water, sewer, electricity, gas, telephone and any other utility used or consumed in the Premises and supplied by a public utility or public authority or any other person, firm or corporation, including Lessor, supplying the same.
Provision of Utilities. In further consideration for the services the WSU Master Gardener Program will provide to manage the DEMONSTRATION GARDEN, the LANDOWNER shall provide and pay the cost for a sufficient, year round supply of water and electricity for the DEMONSTRATION GARDEN. The water and electricity shall use the existing connections to the water and power supplies at the PREMISES. If one or both of those connections must be modified to provide reasonably adequate service to the DEMONSTRATION GARDEN, the cost and plan for such modifications to water or electric lines will be the responsibility of both PARTIES under terms to be negotiated and attached as an amendment to this MOA. The LANDOWNER shall maintain and pay the cost of public road access to the DEMONSTRATION GARDEN and the parking lots currently surrounding it.
Provision of Utilities. Unless otherwise specified in the Contract Documents, Owner will provide all water, sewer, gas, telephone and electric utilities form the point of entry at Owner's property line or, if metering devices are required, to those devices. Owner will provide a telephone line for the project for the use of Contractor and to facilitate communications between Owner and Contractor. Owner will hire a locator service to identify the locations of any underground utilities located on Owner’s property. Failure by Owner to do so shall constitute a waiver of claims arising from an interruption of utilities as the result of Contractor’s activities on Owner’s property. Alternatively, Owner will pay Contractor a fee equal to the actual cost of a locator service, plus a xxxx-up of 20%.
