Project Manager’s Appointment, Duties and Authority 7. The Employer shall appoint the Project Manager who shall carry out the duties assigned to him in the Contract. The Project Manager shall be an independent legal entity or firm duly registered by relevant professional bodies in Tanzania and contracted by the Employer. The Project Manager‟s staff shall include suitably qualified Architects/Engineers and other professionals who are competent to carry out these duties. The Project Manager shall have no authority to amend the Contract without approval of the Employer. The Project Manager may exercise the authority attributable to the Project Manager as specified in or necessarily to be implied from the Contract. Notwithstanding the provisions of this Contract, if the Project Manager is required to obtain the approval of the Employer before exercising a specified authority, the requirements shall be as stated in the SCC. The Employer shall promptly inform the Contractor of any change to the authority attributed to the Project Manager. However, whenever the Project Manager exercises a specified authority for which the Employer‟s approval is required, then (for the purposes of the Contract) the Project Manager shall seek and obtain a written approval of the Employer. Except as otherwise stated in these Conditions: (a) whenever carrying out duties or exercising authority, specified in or implied by the Contract, the Project Manager shall be deemed to act for the Employer; (b) the Project Manager has no authority to relieve either Party of any duties, obligations or responsibilities under the Contract; and (c) any approval, check, certificate, consent, examination, inspection, instruction, notice, proposal, request, test, or similar act by the Project Manager (including absence of disapproval) shall not relieve the Contractor from any responsibility he has under the Contract, including responsibility for errors, omissions, discrepancies and non-compliances. (d) Any act by the Project Manager in response to a Contractor‟s request, except otherwise expressly specified, shall be notified in writing to the Contractor within the period stated in the SCC. Provided that such time shall not exceed 28 days from receipt of the request. The following provisions shall apply: The Project Manager shall obtain the specific approval of the Employer before taking action under the following GCCs of these Conditions: (a) GCC 4.12 [Unforeseeable Physical Conditions]: Agreeing or determining an extension of time and/or additional cost. ...

  • SUPPLIER'S APPOINTMENT The Authority hereby appoints the Supplier as a potential provider of the Services and the Supplier shall be eligible to be considered for the award of Orders for such Services by the Authority and Other Contracting Bodies during the Term and in consideration of the Supplier agreeing to enter into this Framework Agreement and to perform its obligations under it the Authority agrees to pay and the Supplier agrees to accept on the signing of this Framework Agreement the sum of one (£1.00) pound sterling (receipt of which is hereby acknowledged by the Supplier).

  • Non-Promotive Appointment 254. An employee or officer who is a permanent appointee following completion of the probationary period or 2,080 hours of permanent service, and who accepts a non-promotive appointment in a classification having the same salary grade, or a lower salary grade, the appointee shall enter the new position at that salary step which is the same as that received in the prior appointment, or if the salary steps do not match, then the salary step which is immediately in excess of that received in the prior appointment, provided that such salary shall not exceed the maximum of the salary grade. Further increments shall be based upon the seniority increment anniversary date in the prior appointment.

  • Initial Appointment Upon initial appointment, a bargaining unit employee shall be issued a letter of offer, signed by the xxxx/director, citing specific terms and conditions of employment and his or her initial assignment of responsibilities. The University may enclose informational addenda, except that such addenda may not abridge the employee's rights or benefits provided in the BOT-UFF Agreement or BOT- UFF Policies. All academic year appointments for employees at a University shall begin on the same date. Two weeks prior to the beginning of classes each semester, the University shall send to the UFF Chapter a list of bargaining unit employees hired since the beginning of the previous semester, showing name; rank or title; department, college, program or employment unit; salary; and principal place of employment (campus). The initial letter of offer shall contain the following elements:

  • Visiting Appointments A "visiting" appointment is one made to a person having appropriate professional qualifications but not expected to be available for more than a limited period, or to a person in a position which the University does not expect to be available for more than a limited period. A visiting appointment may be offered in single or multi-year appointments not to exceed a total of four (4) consecutive years.

  • Faculty Appointments 5.4.1 On successful completion of the probationary period (unless 6.4 applies), a faculty employee shall be offered a faculty appointment. A faculty appointment means that the appointment shall be continued unless there are exceptional circumstances as specified in 8.4.1 or 6.4.

  • Term Appointments 16.3.4.1 A Term appointment carries no implication of renewal or continuation beyond the contractually limited term. A person holding a Term appointment may apply for a Probationary or Continuing appointment if such a position is available.

  • Medical Appointments Medical appointments may be charged to sick leave, provided the minimum time charged is not less than one-half (1/2) hour. Each absence shall be reported separately and authorized in advance by the employee's immediate supervisor.
