Ownership or Control. The Operator shall comply with the following provisions:
Ownership or Control. Custodian and Depository Bank hereby certify that Custodian is not owned directly or indirectly by any parent corporation of Depository Bank and that Custodian and Depository Bank do not have common controlling shareholders or a common majority of the board of directors or common directors with the ability to control or influence directly or indirectly the acts or policies of Depository Bank. Custodian and Depository Bank shall immediately notify PMIB of any change in ownership of either party that affects this certification and shall transfer the securities to another custodian that is acceptable to PMIB.
Ownership or Control. The transfer of more than twenty-five percent (25%) of the economic interest in Tenant or any entity that directly or indirectly controls or owns fifty percent (50%) or more of Tenant in one or more transactions, regardless of whether Tenant is a publicly or privately held entity, shall constitute a Transfer within the meaning of this Section 113.
Ownership or Control. Except with respect to Patent Rights and Know-How licensed to Regeneron under the Existing Licenses, (a) Regeneron or its Affiliate Controls the Regeneron IP, and (b) Regeneron owns all right, title, and interest in and to all Regeneron Patent Rights in existence as of the Effective Date. Ownership or Control. Summit is the sole and exclusive owner of all Summit Patent Rights set forth on Schedule 1.89 as of the Effective Date. All of such Summit Technology solely and exclusively owned by Summit is free and clear of claims, liens, charges or encumbrances that are inconsistent with the rights granted to Sarepta under this Agreement.

PTI Controls the Licensed Technology in existence as of the Effective Date and, except for any Patent Rights within the Licensed Technology in existence as of the Effective Date that are Controlled by PTI under a Third Party Agreement and sublicensed to Biogen Idec, PTI is the sole and exclusive owner of, or solely Controls, the Licensed Technology in existence as of the Effective Date, and no other Person has any claim of ownership with respect to such Licensed Technology. A COMPLETE VERSION OF THIS EXHIBIT HAS BEEN FILED SEPARATELY WITH THE SECRETARY OF THE SECURITIES AND EXCHANGE COMMISSION PURSUANT TO AN APPLICATION REQUESTING CONFIDENTIAL TREATMENT PURSUANT TO RULE 406 PROMULGATED UNDER THE SECURITIES ACT OF 1933, AS AMENDED. Execution Version transferred, conveyed or otherwise encumbered its right, title and interest in or to the Licensed Technology in a manner inconsistent with the rights and licenses granted to Biogen Idec under this Agreement.
Ownership or Control. The Franchisee shall promptly notify the Franchising Authority of any actual transfer of, or acquisition by any other party of control of Franchisee. A rebuttable presumption that a change, transfer or acquisition of control has occurred shall arise upon the acquisition or accumulation by a person or group of persons of twenty-five percent (25%) or more of the voting shares of Franchisee. For the purpose of determining whether it shall consent to such change, transfer, or acquisition of control, the Franchising Authority may inquire into the qualifications of the prospective controlling party, and Franchisee shall assist the Franchising Authority in any such inquiry.
Ownership or Control. (a) Concurrently with execution of this Agreement, the Operator shall, if it has not previously done so, certify and submit to Capital Health all ownership and control information related to the Operator and the Facility;
