Obligations relating to security clearance. Notwithstanding anything to the contrary contained in this Agreement, the engagement of employees, staff and personnel of the Implementation Agency and of its Contractors and Sub- contractors shall always be subject to security clearance by the delegated GOI agency and only persons having a valid security clearance shall be permitted on the Site. For the avoidance of doubt, it is agreed that refusal of or inability to obtain any such permits and approvals by the Implementation Agency or any of its Contractors or Sub-contractors shall not constitute a Force Majeure Event, and shall not in any manner excuse the Implementation Agency from the performance and discharge of its obligations and liabilities under this Agreement.
