Employee understands that pursuant to federal law any frivolous or legally unwarranted challenge to the validity of this release agreement may result in payment to the Company of its attorney’s fees and other legal costs incurred defending the validity of this Agreement.

The Employee agrees that the Employee will not file, ------------------ or permit to be filed in the Employee's name or on the Employee's behalf, any lawsuit or administrative claim against any of the person or entities released in this Agreement based upon any act or event that is the subject matter of this Agreement and which occurred before the effective date of this Agreement.

Notwithstanding the foregoing, the parties acknowledge and agree that this Agreement and this Section 6 shall not be construed to prohibit the exercise of any rights by Employee that Employee may not waive or forego as a matter of law.
