New Versions. Licensee may choose to license New Versions of the Software at the time of their availability under the terms and conditions of the Agreement and its attached Schedules, subject to the applicable pricing for such New Versions as set forth by Licensor in an appropriate supplement or Order executed by the parties. Licensee is under no obligation to license any such New Versions.

New Versions. New versions of the software specified in Appendix 3 shall be covered by the Agreement, unless otherwise is stipulated in Appendix 1 or Appendix 2. New versions shall be covered by the fixed consideration for maintenance, unless this is priced separately in Appendix 7 (for example, in the case of larger upgrades). When a new version of software can be made available to the Customer, the Contractor shall notify the Customer of this. The Customer shall have the right to ask the Contractor for assistance with installing the new version. The Contractor shall charge the hourly rates for performing the installation work that are set out for such work in Appendix 7, unless otherwise is specified in Appendix 7. Any modifications that were made for the Customer in the version being replaced shall be implemented by the Contractor in the new version before it is made available to the Customer. The Contractor shall charge the hourly rates for performing the modification and implementation work that are set out for such work in Appendix 7, unless otherwise is specified in Appendix 7. The Contractor shall have an obligation, for a minimum of four (4) years after the agreement has come into force, to make new versions of software, etc. covered by the Agreement, cf. Appendix 3, available regularly such that the Customer can comply with the recommended upgrade schedule for new versions of commonly used software that is utilised as part of the Customer's technical platform. Specific deadlines may be agreed in Appendix 5 and software that is exempt from this provision may be specified in Appendix 5.
New Versions. Vendor shall provide Reseller with computer readable copies of all new releases, updates, or revisions of the Software and Documentation within a reasonable time after each such release is made generally available by Vendor. Vendor will notify Reseller of its plans for each new release, update or revision of the Software or Documentation within a reasonable period of time prior to such release.
New Versions. VERITAS may, at its sole discretion, modify the Software Products. Once a new version of the Software Product begins shipping, IMG has sixty (60) days from first VERITAS shipment date or from written notification date, whichever is later, to return Media Kit inventory of the prior release at its expense. Returned packages will be swapped by VERITAS unit-for-unit with the Software Product for the new release of the same Software Product and shipped to IMG at VERITAS' expense. New Versions. CNP may offer maintenance services for Licensed Platform Components in its exclusive discretion ("Maintenance"). As part of Maintenance, CNP may issue modifications to Licensed Platform Components in the form of updates, enhancements or bug-fixes (the "New Versions"). So long as Customer has paid the maintenance fees described herein and has not otherwise breached this Platform License Agreement, CNP shall furnish to Customer any New Versions made generally available to its customers without payment of additional license fees. Customer shall be solely responsible for the implementation of and the compatibility of all New Versions. All of the terms and conditions of this Platform License Agreement shall apply to such New Versions.

New Versions. PeopleSoft may, at its sole discretion, modify the Software. For purposes of this Agreement, PeopleSoft shall have sole discretion as to whether a product is deemed to be a new version of an existing Software program to be provided to Service Provider under the terms of this Agreement, or a new product. Once a new version of an existing Software program begins shipping but before PeopleSoft ceases support of said prior version in accordance with its Support Services, Service Provider shall cease to use the prior version and will remove the prior versions from its servers and destroy such prior version; provided, however, that in no event shall the foregoing obligate or commit PeopleSoft in any way regarding the availability of new versions.
