BA rates and services for use by Fibernet in the carriage of Toll Traffic shall be subject to BA’s tariffs for Exchange Access Service. Adherence to these limitations is subject to a reasonable periodic audit by BA. As applied to wholesale discount rates, unbundled Network Elements or call transport and/or termination of Local Traffic purchased for the provision of Telephone Exchange Service or Exchange Access, the rates and charges set forth in Exhibit A shall apply until such time as they are replaced by new rates as may be approved or allowed into effect by the Commission from time to time pursuant to the FCC Regulations, subject to a stay or other order issued by any court of competent jurisdiction.
