Fair Representation. MSEA-SEIU acknowledges its statutory responsibility to represent and handle grievances for all employees within the bargaining unit. The State shall not be responsible for actions taken or not taken by MSEA-SEIU with respect to its responsibility to provide fair representation.

Partner shall display, demonstrate, and represent Products fairly and shall make no representations concerning Sun or its Products which are false, misleading, or inconsistent with those representations set forth in promotional materials, literature and manuals published and supplied by Sun. Partner shall comply with all applicable laws and regulations in performing under this Agreement.
Fair Representation. The Association shall indemnify and hold harmless the Town against any and all claims, suits, or judgments brought or issued against the Town as a result of any action in which it is adjudged to have been responsible for damages incurred by an employee as a result of action by the Association which violates its duty of fair representation under the standard enunciated by the U.S. Supreme Court in Xxxx x. Xxxxx 000 X.X. 000, provided that the Town has not promoted or instigated such challenge.
