Employee Hiring. Manager will hire, train, promote, supervise, direct the work of and discharge all personnel working on the Premises. Manager shall be the sole judge of the fitness and qualification of such personnel and is vested with absolute discretion in the hiring, discharging, supervision, and direction of such personnel during the course of their employment and in the operation of the Premises.

Employee Hiring. Tenant may hire employees as it deems necessary in order to fulfill its obligations under this Lease. During the Term of this Lease, the hiring, management and separation of employees shall be at Tenant’s sole discretion. Prospective employees must be qualified and satisfy all Rising Star Policies and screening requirements. Tenant will make demonstrable good faith efforts to hire at least fifty percent (50%) of Hotel employees who are individuals residing in Ohio County, State of Indiana (“Hotel Hires”). Tenant will continue to make demonstrable good faith efforts to hire at least fifty percent (50%) of its Hotel Hires from Ohio County, State of Indiana, for the Hotel operation during the Term of this Lease; however, failure by Tenant to hire or continue to employ at least fifty percent (50%) of the Hotel employees be residents of Ohio County, Indiana, despite such demonstrable good faith efforts, does not constitute a default under this Lease. Tenant shall have all appropriate Hotel Hires (that is, all Hotel employees who interact with Hotel guests as part of their customary employment responsibilities) complete the Hospitality/Tourism Program offered by the Education Center of Rising Sun as part of each such employee’s training, so long as such program is offered. Should the Hospitality/Tourism Program be discontinued, or fails to meet Tenant’s training needs, based on Tenant’s reasonable business judgment, Tenant may elect to conduct such hospitality training in-house. Tenant shall provide Landlord with thirty (30) days notification if Tenant decides to discontinue utilization of the Hospitality/Tourism Program.
Employee Hiring. During the term of this Agreement and for six (6) months thereafter, neither party shall directly solicit or recruit any employee or consultant of the other party for itself or for any other company or individual, without the prior written consent of the other party. Nothing in the foregoing sentence shall be construed to prevent either party from hiring an employee of the other party resulting from (i) advertising of open positions, participating in job fairs or the like, or other forms of soliciting candidates for employment which are general in nature or not directed specifically and solely at a given employee of the other party, (ii) unsolicited inquiries about employment opportunities or possibilities from headhunters or other agents acting for unidentified principals, or (iii) unsolicited inquiries about employment opportunities from any employee.
Employee Hiring. Neither Party will hire a current employee of the other Party who performs in any capacity under this Agreement without the prior written consent of the other Party. Notwithstanding the foregoing, neither Party shall be restricted from hiring an employee of the other Party by means of general advertisement.
Employee Hiring. TENANT warrants that it fully complies with all Federal and State statutes and regulations regarding the employment of aliens and others and that all its employees performing work under this Lease meet the citizenship or alien status requirement set forth in Federal statutes and regulations. TENANT shall obtain, from all employees performing work hereunder, all verification and other documentation of employment eligibility status required by Federal or State statutes and regulations including, but not limited to, the Immigration Reform and Control Act of 1986, 8 U.S.C. §1324 et seq., as they currently exist and as they may be hereafter amended. TENANT shall retain all such documentation for all covered employees for the period prescribed by the law. TENANT shall indemnify, defend with counsel approved in writing by COUNTY, and hold harmless, COUNTY, its agents, officers, and employees from employer sanctions and any other liability which may be assessed against the TENANT or the COUNTY or both in connection with any alleged violation of any Federal or State statutes or regulations pertaining to the eligibility for employment or any persons performing work under this Lease.

Landlord and Manager shall confer on and jointly address any and all issues associated with collective bargaining agreements or union representation of employees at the Hotel. Landlord will not unreasonably withhold, delay or condition dissent regarding the unionization of employees.

Employee Hiring. H.O. and Customer agree that each other's employees shall not be hired, induced or otherwise persuaded to become an employee or agent of the other without the written consent of the other party.
Employee Hiring. For purposes of this Section 12, the verb to hire shall mean to hire as an employee and/or otherwise to engage or to retain as an independent contractor or consultant. Provider and Customer acknowledge and agree that each of them has invested substantial time and expense in recruiting, hiring, training and retaining its employees. If either Provider or Customer hires an employee of the other, as a result of the exposure of such employee to Provider or Customer in the course of activities hereunder, the hiring party will receive significant additional value under this Agreement, at the expense of the other party. Accordingly, during the Term and for one hundred eighty (180) days thereafter, neither Provider nor Customer shall hire any person who has been involved in rendering or receiving services hereunder as an employee of the other party, without the express written consent of the other party. The provisions of this Section 12 shall not restrict the hiring of (a) a person who responds to advertising at a job fair or in media circulated to the general public, or (b) a former employee of the other who has not been engaged in a Project hereunder for sixty (60) or more days.

Pursuant to current statute, the Board shall in all instances hire employees who are properly credentialed in accordance with applicable state laws, Washington Administrative Code and by such other requirements as specified by the SPI. All work customarily performed by the District in its own facilities, with its own employees, shall continue to be performed by the District and its employees. The District agrees that for the life of this Agreement, there shall be no outside hiring for services customarily or currently performed by employees.
