Drug Free Workplace Act. The Grantee will assure a drug-free workplace in accordance with 45 CFR Part 76.

Drug Free Workplace Act. The Contractor certifies that the provisions of O.C.G.A. §§ 50-24-1 through 50-24-6 (as may be amended or re-numbered) relating to the “Drug Free Workplace Act” will be complied with in full. The Contractor further certifies that: (i) A Drug Free Workplace will be provided for employees during the performance of the Contract, and (ii) that if a Subcontractor is engaged by the Contractor to work in a Drug Free Workplace, the Contractor shall secure from the Subcontractor the following written certification: “As part of the subcontracting agreement with (Contractor’s name) , (Subcontractor’s name) certifies to the Contractor that a drug-free workplace will be provided for the Subcontractor’s employees during the performance of this Contract pursuant to the ‘Drug Free Workplace Act’”. Contractor also certifies to the Owner and the Engineer that the Contractor and its employees will not engage in the unlawful manufacture, sale, distribution, dispensation, possession, or use of any controlled substance or marijuana during the performance of the Contract.
