Bilateral safeguard. 1. A Party may apply a bilateral safeguard measures, if under procedures established under this scheme, as a result of unforeseen circumstances and particularly the effect of tariff concessions agreed, increases the importation of goods originating into its territory of the other party in absolute terms or relative to domestic production and under such conditions that the imports of such goods, constitute a substantial cause of serious injury or threat thereof to a domestic industry producing a like or directly competing goods. The party into whose territory the good is being imported may to the minimum extent necessary to remedy or prevent the injury:

  • Bilateral Safeguard Measures 1. Where, as a result of the reduction or elimination of a customs duty under this Agreement, any product originating in a Party is being imported into the territory of another Party in such increased quantities, in absolute terms or relative to domestic production, and under such conditions as to constitute a substantial cause of serious injury or threat thereof to the domestic industry of like or directly competitive products in the territory of the importing Party, the importing Party may take bilateral safeguard measures to the minimum extent necessary to remedy or prevent the injury, subject to the provisions of paragraphs 2 to 10.

  • Export Control This Agreement is made subject to any restrictions concerning the export of products or technical information from the United States or other countries that may be imposed on the Parties from time to time. Each Party agrees that it will not export, directly or indirectly, any technical information acquired from the other Party under this Agreement or any products using such technical information to a location or in a manner that at the time of export requires an export license or other governmental approval, without first obtaining the written consent to do so from the appropriate agency or other governmental entity in accordance with Applicable Law.
