Available Relief for a Force Majeure Event. 11.7.1 Subject to this Article 11:
Available Relief for a Force Majeure Event. No Party shall be in breach of its obligations pursuant to this agreement to the extent that the performance of its obligations was prevented, hindered or delayed due to a Force Majeure event. However, adjustment in tariff shall not be allowed on account of Force Majeure event. For avoidance of doubt, neither Party’s obligation to make payments of money due and payable prior to occurrence of Force Majeure events under this Agreement shall be suspended or excused due to the occurrence of a Force Majeure Event in respect of such Party.

Available Relief for a Force Majeure Event. No Party shall be in breach of its obligations pursuant to this agreement to the extent that the performance of its obligations was prevented, hindered or delayed due to a Force Majeure event. For avoidance of doubt, neither Party’s obligation to make payments of money due and payable prior to occurrence of Force Majeure events under this Agreement shall be suspended or excused due to the occurrence of a Force Majeure Event in respect of such Party. The event specified at Article 8.1(a) (xii) above and consequent delay shall be treated as delay beyond the control of the parties and both parties shall be eligible for suitable time extension in the SCOD.
Available Relief for a Force Majeure Event. 8.2.1 No Party shall be in breach of its obligations pursuant to this agreement to the extent that the performance of its obligations was prevented, hindered or delayed due to a Force Majeure event. However, adjustment in tariff shall not be allowed on account of Force Majeure event. Govt. of India from time to time has been issuing Order for waiver of ISTS charges and losses on transmission of wind power. In case the SCOD of the Project is before the date of ISTS waiver as amended from time to time and if commissioning of the Project gets delayed beyond such date due to Force Majeure Event, then the liability of ISTS charges would be shared between the WPG and GUVNL in the ratio of 50:50. However, in case the commissioning is delayed beyond the applicable date of ISTS waiver due to reasons attributable to the WPG, then the entire liability would be of the WPG.
Available Relief for a Force Majeure Event. Except as expressly provided in this Agreement, no party shall be in breach of its obligations pursuant to this Agreement or otherwise liable to the other party for any hindrance or delay in performance or any non- performance of any such obligations if and to the extent that such hindrance or delay or non-performance is due to a Force Majeure Event as defined in Clause 9.3 provided that;

ISTS Charges and losses on transmission of power, including waiver of wind power, shall be as per extant rules and regulations.

Subject to this Article 9 no Party shall be in breach of its obligations pursuant to this AMISP Contract except to the extent that the performance of its obligations was prevented, hindered or delayed due to a Force Majeure Event; every Party shall be entitled to claim relief for a Force Majeure Event affecting its performance in relation to its obligations under this AMISP Contract; in the event on the 10th anniversary of the date of execution of this AMISP Contract, the AMISP has not operated the AMI system for Total Meter-Months of operating the AMI system after Operational Go-Live due to a Force Majeure Event(s) the Utility shall extend the term of this AMISP Contract by such duration as may enable the operation of AMI system for the Total Meter-Months of operating the AMI System after Operational Go-Live.

Provided that no payments shall be made by either Party affected by a Force Majeure Event for the period of such event on account of its inability to perform its obligations due to such Force Majeure Event.
