Ability to Contract. A direct primary care service agreement is an agreement between the direct primary care provider and either an individual or the individual's representative, regardless of whether the periodic fee or other fees are paid by the individual, the individual's representative or a 3rd party. [PL 2017, c. 112, §1 (NEW).]
Ability to Contract. Developer warrants that it has full ownership interest in the Property such that Developer has the legal authority and ability to enter into this Agreement and fulfill the terms contained herein.
Ability to Contract. Each party represents that it is not subject to any restrictive obligations imposed by any other Agreement or agreement that would impair its ability to perform its obligations hereunder. The individual or individuals signing on behalf of each party represent that they are fully authorized by law, statute, delegation, or otherwise to execute this Agreement and make it binding and enforceable against the party on whose behalf the individual or individuals is or are signing.
Ability to Contract. Seller has the full right, power and authority to enter into this Agreement to sell and convey the Property to Buyer and this Agreement shall be a valid and binding obligation of Seller, subject to the terms and conditions contained herein.
Ability to Contract. Buyer has the authority to enter into this Agreement and this Agreement shall be a valid and binding obligation on Buyer, subject to the terms and conditions contained herein.
Ability to Contract. The Parties represent and warrant to each other that they are not prohibited from entering into this Agreement, selling the Products or otherwise conducting business with each other as contemplated herein, whether due to any contract to which either is a party, or other commitment or obligation binding on either party.
Ability to Contract. Contractor warranties that it has the legal ability to enter into this Agreement and fulfill the terms contained herein.
Ability to Contract. NIRDA represents to Contractor that NIRDA has obtained all legal consents necessary to award this contract to Contractor without competition, and that award of this contract is made in accordance with all applicable law, regulations, rules, policies, and requirements. Non-Collusion and Acceptance The undersigned attests, subject to the penalties for perjury, that the undersigned is the Contractor, or that the undersigned is the properly authorized representative, agent, member or officer of the Contractor. Further, to the undersigned's knowledge, neither the undersigned nor any other member, employee, representative, agent or officer of the Contractor, directly or indirectly, has entered into or been offered any sum of money or other consideration for the execution of this Contract other than that which appears upon the face hereof. Furthermore, if the undersigned bas knowledge that a state officer, employee, or special state appointee, as those terms are defined in IC 4-2-6-1, has a financial interest in the Contract, the Contractor attests to compliance with the disclosure requirements in IC 4-2-6-10.5.
Ability to Contract. Each party has the full right, power and authority to enter into this Agreement to sell and convey the respective lots to the other party and this Agreement shall be a valid and binding obligation of both parties, subject to the terms and conditions contained herein.
Ability to Contract. Xxxxxx and Xxxxx warranty they have the ownership interest in the Property required to enter into this Agreement and fulfill the terms contained herein.
